Egg Donation Law Overview

Are you donating your eggs (also called "ova") to someone? Or using donated eggs to have a child? While this can be both a stressful and exciting time, it is important to ensure you take the time to understand your legal rights and obligations. Unless the donation is anonymous (and sometimes even then), you should have a written ova donation agreement with the donor/recipient(s).

Purpose of Egg Donation Agreement

Egg donor agreements help ensure that everyone is on the same page and reduce the chance of a conflict arising in the future. They can also help protect your rights. For example, if you are a donor you will want to be very clear that you are not a parent and will not be responsible for supporting the child. Likewise, if you are the parent(s) you will want to be very clear the donor is not a parent and will not have any parental rights to the child.

There are also a variety of less obvious things to consider, from posting pictures on social media to sharing information about genetic disorders in the future. In almost every meeting about egg donation our clients usually say “oh, we never thought of that!” We can help you with all of the legal aspects of egg donation in Ontario. Lisa Feldstein is a fertility lawyer who has helped over a hundred people create families through assisted reproduction. She drafts surrogacy agreements, helps clients obtain birth certificates and passports for their babies, and provides legal advice to surrogates, gamete donors and fertility clinics.

Lisa has presented on reproductive law at numerous institutions including the University of Toronto, Mount Sinai Hospital, Markham Fertility Centre and the 519 Church Street Community Centre. She is also an adjunct professor of Health Care Law at York University, and wrote a book chapter on Reproductive Health Law.
